1. Acceptance of Terms
By downloading, accessing, or using the NWA Homes for Sale application (the "App"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any of these Terms, you are prohibited from using or accessing the App.
2. Eligibility
You must be at least 13 years old to use the NWA Homes for Sale App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are under 18, you represent that you have your parent or guardian's permission to use the App.
3. Description of Service
The NWA Homes for Sale App provides:
Real-time residential real estate listings for Northwest Arkansas sourced from the local MLS
Property search and filtering by location, price, bedrooms, bathrooms, and other criteria
Map-based neighborhood search
Saved searches, favorites, and price alert notifications
The ability to contact local real estate agents directly from listings
Property photos, details, and listing information
The App is designed for consumers searching for homes in Northwest Arkansas, including Benton County, Washington County, and surrounding areas.
4. Account Registration
Certain features of the App, such as saving favorite listings, setting price alerts, and contacting agents, require you to create an account. You agree to:
Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Maintain the security and confidentiality of your login credentials
Accept responsibility for all activities that occur under your account
Immediately notify us of any unauthorized use of your account
5. Free Service
The NWA Homes for Sale App is provided free of charge. We reserve the right to modify, limit, or discontinue any features at any time, introduce paid features or subscriptions in the future with advance notice, and limit usage to ensure service availability for all users.
6. MLS Data and Listing Accuracy
6.1 Data Sources
Property listings displayed in the App are sourced from the Northwest Arkansas Multiple Listing Service (MLS) and other third-party data providers. While we strive to provide accurate and up-to-date information, we do not guarantee the accuracy, completeness, or timeliness of any listing data.
6.2 No Guarantee of Availability
Listings displayed in the App may have already been sold, withdrawn, or otherwise become unavailable. The display of a listing does not guarantee the property is currently for sale or available at the listed price.
6.3 Not an Appraisal
Any property valuations, estimates, or market data provided through the App are for informational purposes only and should not be relied upon as an official appraisal or guaranteed property value. Always consult a licensed appraiser or real estate professional for official valuations.
7. Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:
Violate any local, state, or federal laws or regulations
Use the App to engage in discriminatory practices prohibited by Fair Housing laws
Harvest, scrape, or collect data from the App using automated systems or software
Interfere with or disrupt the App's functionality or servers
Attempt to gain unauthorized access to any portion of the App
Use the App for any commercial purpose, including reselling or redistributing listing data, without our express written consent
Share your account credentials with unauthorized parties
Misrepresent your identity or affiliation
8. Intellectual Property
8.1 App Ownership
The App and its original content, features, design, and functionality are owned by NWA Homes for Sale and are protected by copyright, trademark, and other intellectual property laws.
8.2 MLS Content
Property listing data, photographs, and related content are the property of the respective listing brokers and the MLS. This content is displayed under license and may not be copied, redistributed, or used for any purpose other than personal, non-commercial viewing within the App.
9. Privacy and Data Protection
Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and processing of your data as described in the Privacy Policy.
10. Account Deletion
You may delete your account at any time through the App's settings or by contacting us directly. Upon account deletion, we will remove your personal data in accordance with our Privacy Policy, though certain data may be retained as required by law or for legitimate business purposes.
11. Third-Party Services
The App may contain links to or integrations with third-party services, including but not limited to MLS providers, mapping services, mortgage calculators, and agent websites. We are not responsible for the content, practices, or availability of third-party services and encourage you to review their terms and privacy policies.
12. Disclaimers and Limitation of Liability
12.1 "As Is" Basis
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12.2 No Warranty
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or harmful components, that defects will be corrected, or that listing data or other content will be accurate, complete, or reliable.
12.3 Limitation of Liability
In no event shall NWA Homes for Sale, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the App.
13. Indemnification
You agree to indemnify, defend, and hold harmless NWA Homes for Sale, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, your violation of these Terms, or your violation of any rights of another party.
14. Termination
We may terminate or suspend your account at any time, with or without cause and with or without notice. Upon termination, your right to use the App will cease immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect.
15. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Your continued use of the App following notification constitutes acceptance of the modified Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arkansas, without regard to conflict of law provisions. Any legal action arising from these Terms shall be filed in the courts located in Washington County, Arkansas.
17. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good faith negotiations. If resolution cannot be reached within 30 days, disputes shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Washington County, Arkansas.
18. Severability
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and NWA Homes for Sale regarding the use of the App and supersede any prior agreements.
